Termination of Temporary Protected Status for Haiti and Syria On June 25, 2026, the Supreme Court decided Mullin v. Doe, which reversed a lower court decision that blocked the Trump Administration’s termination of TPS for Haitians and Syrians (See Mullin v. Doe, No. 25-1083). This means that the protections and benefits of Haitian and Syrian TPS will soon terminate, likely within days or weeks, when the judgment in Mullin is issued. Until that happens, existing TPS-based work authorization remains in place and employees should not be terminated preemptively. The Trump administration will likely update the USCIS website and E-verify with the operative date. Employers should monitor the USCIS website, E-verify, and this guidance for the final operative date of the Mullin v. Doe decision. See USCIS website: TPS Haiti and https://www.uscis.gov/humanitarian/temporary-protected-status/temporary-protected-status-designated-country-haiti.
Employers are advised to review this TPS Guidance for Employers which has been issued jointly by Governor Maura Healey and Attorney General Andrea Campbell.
