Legal Alert: Wage Act Class Action Lawsuits

RAM members should be aware of the recent wave of class action lawsuits that have been filed against Massachusetts employers alleging violations of the Massachusetts Wage Act.  The increase in activity comes on the heels of the Massachusetts Supreme Judicial Court’s 2022 Reuter decision which adopted a strict liability standard for Wage Act violations.  This means any violation, even those technical in nature, now automatically triggers the law’s treble damages, interest and legal fee provisions.  With no flexibility for good faith mistakes, the decision has served as an incentive for unscrupulous plaintiff attorneys to seek out technical violations of the law to base future class actions upon.  
 
In the most recent line of cases, employers are alleged to have paid salaried employees on a monthly basis involuntarily.  Under the law, certain salaried employees are required to be paid on a bi-weekly or semi-monthly basis, unless the employee voluntarily elects to be paid on a monthly basis.  Initially, the lawsuits targeted only non profit employers, but after the Legislature granted them immunity as part of the state’s 2025 Budget, the focus has shifted to for profit employers.
